      Temporary Resident Permit(TRP)

       

      Individuals who are found to be inadmissible to Canada due to misrepresentation, criminal, medical reasons, or security, but have a reason to travel to Canada that is justified in the circumstances, can apply for a Temporary Resident Permit (“TRP”).

       

      Definition of Temporary Resident Permit(TRP)

      A TRP is a temporary pass that allows individuals that are classified as being inadmissible to travel or stay in Canada. Individuals who do not meet the requirements of the Immigration Refugee Protection Act (“IRPA”) and Immigration Refugee Protection Regulations (“IRPR”), typically require a TRP.

      A TRP grants an individual legal entry to Canada for a certain period of time although the individual is inadmissible. It is a pass that temporarily excuses the individual’s inadmissibility so that allows he or she could enter Canada. It can be valid for as little as 2 days and a maximum of 3 years, and it may be extended for another 2 years. Though, the time validity of TRP usually varies greatly depending on the circumstance of the applicant.

      A temporary resident permit is listed in section 24 of the IRPA.

      Temporary resident permit

      24(1) A foreign national who, in the opinion of an officer, is inadmissible or does not meet the requirements of this Act becomes a temporary resident if an officer is of the opinion that it is justified in the circumstances and issues a temporary resident permit, which may be cancelled at any time.
      Exception
      (2) A foreign national referred to in subsection (1) to whom an officer issues a temporary resident permit outside Canada does not become a temporary resident until they have been examined upon arrival in Canada.
      Instructions of Minister
      (3) In applying subsection (1), the officer shall act in accordance with any instructions that the Minister may make.

       

      Eligibility of TRP

      To be eligible for a TRP, you must demonstrate that your reasons for visiting or staying in Canada will not pose a risk or safety concern to Canada and its citizens. Your needs to enter or stay in Canada must outweigh the health or safety risks to Canadian society, as determined by an immigration or a border services officer.

      Those are some ideal examples which can be considered as reasons you need to be in Canada:

      • Family ties
      • Wedding
      • Funeral
      • Medical treatment
      • Business or work-related travel
      • Job qualification
      • Economic contribution
      • The intention of the legislation such as protecting public health or the health care system

       

      The procedure of TRP Application

      Applying for a TRP requires that an applicant proves the need for their trip to Canada. The processing time for a TRP is approximately 1 to 6 months and each TRP applicant needs to pay a non-refundable $200.00 application fee. This fee must be submitted at the time the applicant files his or her application.

      Please note that there is no guarantee that you will be issued a TRP, and also it can be cancelled at any time. There are strict guidelines outlined in your TRP that must be followed to ensure the permit is not revoked.
